Homicide Investigation

The Birmingham Police Department reports that an unclassified death investigation has been ruled a homicide. The incident occurred on Thursday, January 13, 2011 at approximately 1:30 p.m. at 5008 1st Avenue North.

Officers from the East Precinct responded to the incident location to investigate a report of a deceased person. Upon arrival officers located the victim lying inside a motel room unresponsive. Birmingham Fire and Rescue responded to the scene and pronounced the victim deceased. Investigators later received information from the victim’s family that the victim suffered from chronic seizures as a result of a gunshot wound to the head he sustained in December of 2006. The injury was a result of a domestic dispute with his girlfriend.

Following the medical examination, the Jefferson County Coroner’s office released an official report that classifies the victim’s cause of death a homicide. The report which cites the cause of death as a seizure disorder, relates the seizures to the gunshot wound that was reportedly inflicted by another person in December of 2006.

The victim has been identified as:  Fred Battle, B/M, 35, of Birmingham, Alabama.

The suspect was charged with assault 1st degree after the shooting, but was acquitted at her trial. Investigators have consulted with the DA’s office who advised that no charges will be pursued in this case due to the time frame from the shooting to the victim’s death.
